Your privacy and security of personal data forwarding are a priority for ABC Supermarkets AS (hereinafter ABC Supermarkets).

For better servicing of our customers and due performance of all contractual relationships, ABC Supermarkets collects and retains the data of customers and other persons in adherence to the principles provided below; foremost:

– personal data are collected in the minimum possible amount,

– personal data are used only purposefully for the objective of rendering services, concluding and performing agreements/contracts, establishing identity, contacting relevant persons, and advertizing our services.

We have applied technical and organizational measures to protect your data from loss, alteration, theft, and unauthorized access. Only duly authorized persons have access to your personal data.

The principles set out in this Privacy Policy are not applicable where data of bodies corporate, including natural persons as authorized representatives of a company, are processed.

The Privacy Policy is applicable to all customers and users that are natural persons and purchase goods, products, and services offered by ABC Supermarkets and that visit the company ABC Supermarkets’ stores (Comarket, Delice, Solaris Food Store), websites (www.comarket.ee, www.delice.ee, www.abccom.eu) ), or social media accounts.

Our websites may include external links to other parties’ websites. Please note that our Privacy Policy does not include the terms and conditions of processing of personal data on such other parties’ websites.

Purposes of data collection and processing

ABC Supermarkets processes personal data for the following purposes:

  • administering customer relations and customer communication
  • concluding and performing customer agreements
  • replying to customer inquiries
  • developing and analyzing customer relations
  • offering products and services
  • direct marketing
  • surveying consumer habits
  • administering and developing services
  • using and improving our websites
  • carrying out of raffles and surveys
  • preparing sales statistics
  • protecting of property and individuals
  • performing obligations arising from legislation

Direct marketing

Your consent is strictly required to use your personal data for direct marketing purposes such as inviting you to take part in campaign games and raffles, and sending you newsletters and offers by way of communication channels chosen by you: post, text message, e-mail, social media. Video recordings

ABC Supermarkets stores use video surveillance for the purpose of protection of individuals and property.  All such video recordings are available only to persons that have the right to view the video recordings as proceeding from their duties.

Use of cookies

ABC Supermarkets websites use cookies. A cookie is a small text file stored automatically on the user's device by the user's web browser. Cookies are employed to collect information on how the user uses the website with the objective of providing an improved user experience.

What type of data is collected?

For the purpose of improved rendition of relevant services, ABC Supermarkets may, in the extent required for rendition of relevant services, collect personal data which foremost include, yet are not limited to your name, personal ID code, e-mail address, postal address, telephone number, and technical information forwarded by digital devices (e.g. cookies and other similar technologies) as well as your image and other personal data and actions viewed in an area under video surveillance.

ABC Supermarkets has the right to refuse to provide a service if provision of such a service is impossible without processing of personal data.

From which sources is personal data collected?

You

ABC Supermarkets collects your personal data with your consent at the beginning and during the relevant customer relationship. We only collect your personal data if you forward such information voluntarily.

In-store video surveillance cameras

We collect and process personal data, using technical measures, i.e. security cameras, video surveillance systems, and other similar technologies.

Sharing of personal data

Service providers

In processing your personal data, ABC Supermarkets may use third party service providers that render required services (e.g. software development, forwarding of direct marketing measures, payment and postal services) to us. Such companies can process your personal data only in adherence to our instructions and may not use your data for any other purposes. They are also obligated to protect your personal data in compliance with legislation and their cooperation agreement with us.

Law enforcement authorities

ABC Supermarkets has the right to forward personal data to supervisory authorities, investigative bodies, and law enforcement authorities in cases provided for in legislation.

Where do we process your personal data?

We always process your personal data within the European Union and the European Economic Area. Your personal data is not forwarded or processed in countries outside of above areas.

For how long is my personal data retained?

ABC Supermarkets may process your personal data for as long as it is required to perform the customer relationship between ABC Supermarkets and you or another equivalent relationship until you withdraw your consent to processing of your personal data or until expiry of terms prescribed by law as related to taxation and legal purposes.

As relating to the ABC discount card program, a card user’s personal data and purchase information are retained for a duration of three years as from expiry of the card, and upon expiry of said term, relevant personal data is erased automatically.

Any personal data related to complaint, claim, and inquiry management are retained for a duration of one month as from our last reply to you, yet for no longer than one year as from receipt of the complaint, claim, or inquiry. If a legal dispute is ongoing in connection to resolving a complaint or claim, related personal data is retained for up to three years as from resolving of the complaint or expiry of the legal dispute. If the complaint is resolved by way of a compromise, your personal data is retained for a duration of seven years as from conclusion of the compromise.

Any personal data related to organizing and managing campaign games, raffles and/or competitions and to ascertaining and announcing a winner is retained for a duration of three years as from expiry of the relevant campaign. By participating in a campaign, campaign participants grant their consent to the campaign organizer to use their personal data in ascertaining the winners of campaign’s raffle prizes and in delivering the prizes won, also in publishing the names of the winners on ABC Supermarkets websites, in (social) media, advertisements, and PR campaigns without paying any additional fee therefor. If a complaint is filed in relation to campaign games and/or competitions, personal data may be retained for a longer period of time. In such a case, personal data is retained for up to three years as from resolving of the complaint or expiry of the legal dispute. If a complaint is resolved by compromise, your personal data is retained for a duration of seven years as from conclusion of the compromise.

Video recordings are as a rule retained for up to three months, except if the need to retain such recordings for a longer period of time arises from ongoing supervision proceedings related to protection of individuals and property. In such a case, recordings are retained until resolving of the identified issue or termination of relevant investigation.

After expiry of said terms, we erase your personal data in a secure manner so that such data can no longer be connected to your person.

Your rights

Data protection legislation equips you with a number of rights in relation to processing of your personal data.

Right of access to personal data

You have the right to request access to personal data collected as relating to you. If you wish to receive a copy of your personal data, so as to ensure security, we can e-mail it to you only in an encrypted format, adding you as the recipient of the file by using your ID code. If you do not have the technical capacity to open said file or if your ID code does not enable you to be set as a recipient of an encrypted file, you will receive the requested document visiting our office in person.

Right to rectification of personal data

Furthermore, if you find data concerning you to be incorrect or incomplete, you have the right to request that we amend such data.

Right to withdraw consent

If you have granted your consent to use of your personal data for purposes related to direct marketing, you have the right to withdraw your above consent to processing of your personal data at any time.

Right to object to legitimate interest based data processing

You have the right to object to data processing undertaken based on our legitimate interests. Nevertheless, we will continue processing your personal data even if you object thereto if we foster compelling legitimate reasons to continue said data processing. To use said right, kindly submit to us relevant written request to that effect.

Right to erasure

Under certain circumstances you have the right to demand from us complete or partial erasure of your personal data. This does not apply if we are obligated by law to retain your personal data. To have your personal data erased, kindly submit to us relevant written request to that effect.

Right to restriction of processing

Under certain circumstances you have the right to restrict the processing of your personal data. To use said right, kindly submit to us relevant written request to that effect.

Right to data portability

You have the right to request that your personal data be transmitted to another controller (data portability). This right only includes such data which you have given to us by your consent or agreement and in relation to which processing is carried out automatically. To use said right, kindly submit to us relevant written request to that effect.
